Terms of Service

The agreement, plainly written

Effective April 27, 2026

These terms cover your use of stitchedmemory.com, the keepsakes we make for you, and the photo galleries linked to them. By placing an order, contributing to a gallery, or using the site, you agree to what's below.

Who we are

Stitched Memory is a handmade keepsake studio operating at 54 Gateway Dr, Jasper, GA 30143. In these terms, “we,” “us,” and “Stitched Memory” mean the studio. “You” means the person ordering, contributing, or using the site.

Eligibility

You need to be at least 18 years old, or have a parent or guardian place the order on your behalf, to buy a keepsake. Anyone of any age can be the subject or recipient of a keepsake — it's the person paying who needs to be an adult.

What we make

We make handcrafted keepsakes — Memory Bears, Cuddle Bears, Loyal Pups, and Memory Blankets — sewn from clothing or fabric you mail to us. Every keepsake ships with a small NFC tag sewn inside that links to a private digital photo gallery, plus a woven recovery ribbon bearing your unique order number as a permanent backup identifier.

Ordering and payment

When you check out, you authorize us to charge your payment method for the full order total — keepsake, any gallery upgrade, and any drop-ship fees for alternate addresses. Payment is processed by Stripe; we never see or store your card number. After you pay, we email a prepaid USPS shipping label so you can mail your clothing to us.

Pricing displayed on the site is in U.S. dollars and may change at any time, but the price you saw at checkout is the price you pay for that order.

Your clothing and our work on it

By mailing us your clothing, you authorize us to cut, sew, piece, and incorporate it into the keepsake you ordered. Once a garment is cut, that change is permanent. Send only items you are ready to commit to the keepsake.

You confirm that the garments you send are yours to use this way (yours, an immediate family member's, or otherwise authorized by the owner). We are not able to verify ownership and rely on you to send only what is yours to send.

Some garments age poorly, contain hidden damage, or are made from fabric that doesn't hold up to cutting and sewing. We'll do our best, and Katie will reach out if a garment is unworkable, but we cannot guarantee that every fabric will survive the build. Your remnants are returned with the keepsake unless you chose otherwise at checkout.

Refunds, shipping, and timelines

Refunds are governed by our Refund Policy and shipping is governed by our Shipping Policy. Both are part of these terms. The short version: you can cancel for a full refund any time before your fabric arrives at our studio; once we've received your fabric, the order is non-refundable, but if we make a mistake or the keepsake arrives damaged we'll repair, remake, or replace it. Production time is typically 2–4 weeks from fabric received to shipped.

Your gallery and the photos in it

Every order includes a Cherish gallery; Heirloom and Legacy tiers are optional one-time upgrades. The gallery is private by default — only people with the share link or NFC tag can view it.

You own the photos you upload. By uploading them, you grant Stitched Memory a worldwide, royalty-free, non-exclusive license to host, store, display, transmit, and process those photos solely for the purpose of running your gallery. We will not use your photos in marketing, social media, or any public-facing material without your explicit written permission.

You are responsible for the photos you (or contributors you invite) upload. By uploading, you confirm that you have the right to do so and that the photos do not violate anyone's privacy, copyright, or other rights. We reserve the right to remove content that violates these terms or applicable law.

Contributions submitted via a share link are held in a pending queue and become visible only after the gallery owner approves them.

What you may not do

  • Upload content that is illegal, infringes someone's rights, or depicts a minor in a sexual or exploitative way.
  • Upload content that you do not have permission to share.
  • Send us garments that aren't yours (or that you don't have permission to use).
  • Use the site to harass, defraud, or impersonate another person.
  • Attempt to break, scrape, overload, or reverse-engineer the site or our infrastructure.
  • Use the NFC tag, ribbon, or any part of the keepsake to claim affiliation with Stitched Memory beyond your own ownership.

Our intellectual property

The Stitched Memory name, logo, “every stitch tells a story,” the “by Katie” signature, the site design, and all original content we publish are owned by Stitched Memory. You can't copy or reuse them without our written permission. The keepsake we make for you is yours, including the physical materials you sent in.

Disclaimers

We provide the site and our services “as is.” We do our best — Katie inspects every keepsake before it ships — but we don't make legal warranties about the site's uninterrupted operation, the suitability of any particular fabric, or the long-term durability of an individual keepsake under any specific use. The only commitments we make beyond the laws that already apply are the ones written in these terms and our policy pages.

Limitation of liability

To the maximum extent permitted by law, Stitched Memory's total liability for any claim arising from your order, the site, or these terms is limited to the amount you paid for the order in question. We are not liable for indirect or consequential damages, including emotional damages from damage to or loss of clothing during shipping or production, beyond the limited remedies in our refund policy. Some jurisdictions don't allow these limits; in those places, our liability is limited to the smallest amount the law allows.

Indemnification

You agree to defend and hold harmless Stitched Memory from third-party claims arising out of content you upload to a gallery, garments you send us that you didn't have the right to send, or your violation of these terms.

Termination

You can stop using the site or close your gallery at any time by emailing us. We can suspend or close an account or gallery if it violates these terms or applicable law. If we suspend access for a violation, we'll let you know unless doing so would interfere with an investigation.

Governing law and disputes

These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute that can't be resolved by emailing us first will be resolved in the state or federal courts located in Pickens County, Georgia, and you and we agree to that venue.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the effective date above. For significant changes, we'll email gallery owners and newsletter subscribers. Continued use of the site after the change means you accept the updated terms.
